3. How We COLLECT and Use YOUR PERSONAL Information
A. What Is Personal Information? Personal information refers to information that we can use to personally identify a specific individual. Different laws define personal information (and similar terms, such as personal data, personally identifiable information, and PII) to include different things, but it generally includes information like your name, physical address, e-mail address, and phone number. It may also include your computer or mobile device IP address, if that IP address can be linked to a particular person, or geo-location information, again if that information can be used to pinpoint a specific person.
If you are not comfortable with providing information to us, you should not do so. Although that will affect our ability to communicate with you and provide you with products and services through the site, that is your choice. If you do provide us with any personal information, you agree that it will be accurate and complete, and you understand that it is your responsibility to update your personal information as necessary to keep it current.
C. The Personal Information We Collect. Our site has been designed to allow people to place pre-order reservations for the Himalayan 2021. If you choose to make a reservation, you will be asked for the following information:
• Your first and last name;
• Your phone number;
• Your email address; and
• Your street address, including ZIP Code.
You will also be asked for information about your preferences, such as the color and any other optional features of the Himalayan 2021 you wish to order.
When you use our site, your browser may request you to allow it to provide us with your location. In addition, if you access the site on a mobile device, then depending on your permissions and settings, certain location data may be collected, depending on factors such as the device you are using (smartphone or tablet) and how you are connected to the internet (cellular or wifi). We will use this information to direct you to your closest Royal Enfield dealer. Most devices allow you to disable location services, usually via your device’s settings menu. If you have questions about disabling location settings, you should contact your mobile service provider or device manufacturer
In addition, if you reach out to us via any “Contact Us” or similar feature of the site, we will collect any personal information you include in your inquiry.
D. How We Use Your Personal Information. We collect and use this this information to manage and personalize your experience on the site (including locating nearby dealers), to respond to any inquiry you send to us, to manage your reservation request, to communicate with you about your reservation (including sending you a personalized Buyer Code identifying your order), and to provide your chosen dealer with information about your reservation. In addition, subject to your legal rights to opt out under applicable law, we will use your contact information to send you emails, newsletters, or other promotional materials about products and services you may be interested in, to provide you with relevant content, and to seek your feedback on your site experience.
We will also use the information you provide for internal business purposes, such as evaluating interest in our products, to evaluate and improve product and service quality, to comply with legal requirements, and to prevent and address fraud and breaches of our site requirements and policies.
We will keep your information for as long as we continue to have a business need to do so (which will be for at least as long as your reservation and pre-order remain outstanding), unless a longer period is required by law. Business needs include legal, tax, accounting, risk management, and other business purposes.
4. HOW AND WHY WE SHARE PERSONAL INFORMATION
We only share personal information with third parties in the following circumstances:
• We will share your reservation request with the dealer you select when submitting your reservation, which is necessary in order for the dealer to process your request and reserve your selected Himalayan 2021 in inventory.
• We may provide personal information to our trusted service providers who need to use that information to conduct business on our behalf. If we do so, we will provide these service providers only with the information they need to perform their services, and work with them to respect and protect your privacy.
• We may share personal information with data analytics platforms to compile statistics and perform analyses intended to understand our customer base and to improve our site performance.
• We will release information, including personal information, if we believe that doing so is appropriate to (a) comply with law, regulations, legal process, or governmental requests, (b) enforce any policies applicable to the site, including potential violations, (c) detect, prevent or otherwise address fraud, security or technical issues, or (d) otherwise protect the rights, property, or personal safety of us, our employees, site users, or others.
• We may share information, including personal information, in connection with, during negotiations of, or as a part of the closing of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company in which personal information about the users of the site is among the assets transferred.
• We may also share personal information that has been de-identified or anonymized, such as demographic information or aggregate information, with our advertisers and marketing partners for business purposes, such as the development of marketing campaigns.
We do not provide any personal information that we collect about you through the site to anyone for any purpose other than those listed above, and will not do so unless you have given us your separate express permission to do so.
5. How We Collect and Use Non-Personally Identifiable Information
B. How We Collect Non-Personally Identifiable Information. When you visit the site or interact with us electronically, we may automatically collect standard internet and website log information, and details of patterns about how our site visitors behave. This information may include your internet service provider name, your operating system, your browser type and browser language, your access dates and times, the website that referred you to the site, the specific web pages you visit and the date and time of those visits, your search terms and queries, and links clicked as you visit the site. We may also use analytics tools that collect information about how the site is used, such as how often users visit our site, what pages they visit, and what other sites they use prior to visiting our site. More information about the technology and analytics services we use to automatically collect information is provided below under the heading “Cookies and other Tracking Technologies.”
6. COOKIES AND OTHER TRACKING TECHNOLOGIES
B. Analytics Services. Our site may use analytics tools to collect information about the use of our site, so that we can understand our visitors’ online behavior. In these instances, the analytics service provider will be able to use and share information about your visits to and use of our site, and that service provider’s use and sharing will be governed by their privacy notice and online terms.
D. Do Not Track Requests. Currently, certain browsers, including Firefox, Google Chrome, Safari and Microsoft Edge, offer a “do not track” (DNT) option. This option, using a technology known as a DNT header, sends a signal to websites visited by the user about the user’s DNT preference, if any, set on the browser. We do not currently commit to responding to browsers’ DNT signals, because no common industry standard for DNT has been adopted by industry groups, technology companies, or regulators.
7. SOCIAL SHARING FEATURES
Our site may offer social network and similar sharing features, such as Facebook, Twitter, YouTube, and/or Instagram buttons, which let you share information related to the site through your preferred social media platforms. If you permit a connection between our site and your social network page(s), we (and the social network) may be able to identify you, and associate the information we (and they) receive with information we (and they) already have about you. In addition, depending on how you use those features and your settings with the social network provider(s), the information you share to your social network pages will be available to others, including your friends and/or the public. For more information about how your information may be shared through those social networks once it is provided to them, you should review the privacy policies of those social networks.
We also may share certain data with these social networks to allow us to target existing users and customers with relevant advertising. In this situation, we do not share your identification or contact information with anyone. Instead, a unique code is shared with the applicable social network, allowing that code to be matched against existing users of the applicable social network, and to identify potentially relevant audiences for target advertising.
8. Our Security Measures
We use a variety of industry-standard security measures to maintain the safety of your personal information, including measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration and disclosure. We store the personal information you provide on secure (password- and firewall-protected) servers. All electronic financial transactions conducted through our site are protected by encryption technology. Unfortunately, no electronic data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we believe that we use reasonable measures to protect personal information, we cannot ensure or warrant the security of any information transmitted or otherwise provided to us or received from us.
9. YOUR RIGHTS REGARDING Your Information
A. Opting Out of Providing Information. All personal information provided through the site requires your voluntary submission, except for browsing and device information, which is automatically collected if you use the site. You should refrain from visiting the site if you do not want any browsing or device information collected. It is otherwise your choice whether or not to provide us with information, such as by making or declining to make a reservation for a Himalayan 2021 through the site.
B. Opting Out of Certain Communications. You can always opt out of receiving promotional email communications from us by using the “unsubscribe” link contained in those communications, or by contacting us at firstname.lastname@example.org. Please note that notwithstanding your email preferences, we may need to contact you regarding outstanding or previous orders, as required by law or regarding legal matters.
C. Correcting and Updating Information. If you believe that any of the personal information we have about you is incorrect, you can contact us at any time at email@example.com to request that we make the appropriate corrections.
D. Removal of Information. As noted above, we have standard retention practices with respect to the personal data we collect. If you would like to request any earlier removal of your personal information, please contact us at firstname.lastname@example.org. Please note that we may not be able to completely remove personal information from the site or our systems in certain circumstances. This will be true if the data is not in a searchable format, if it is retained in backup systems, if we need it in order to prevent fraud or future abuse, or if we are required by law to keep it. We will inform you if we cannot remove information as requested.
E. California “Shine the Light” Rights. The California “Shine the Light” law permits individuals to request certain details about our disclosure of their personal information to third parties for direct marketing purposes. If you are a California resident and you would like to make such a request, please contact us at email@example.com.
10. A NOTE ABOUT CHILDREN
Our site is not directed to persons under the age of 13. We do not knowingly collect personal information from children under 13. If you believe your minor child has improperly accessed the site and provided any personal information, please contact us at firstname.lastname@example.org.
11. VISITING OUR WEBSITE FROM OUTSIDE THE UNITED STATES
Our site is intended for a United States audience. If you are visiting our site from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States, where our servers are located and our site is operated. We make no representation that the practices we describe in this Privacy Notice are compliant with the laws of other jurisdictions, including laws that apply to the collection, use, disclosure, and security of personal information.
