Last Modified: August 24, 2020

1. INTRODUCTION
This Privacy Policy (“Privacy Policy”) is being provided to visitors to the Royal Enfield Himalayan 2021 Pre-Sale website, located at https://www.royalenfieldna.com/ (which we refer to in this Privacy Policy as the “site,” which also includes all associated content, functionality, and services offered on or through the site).
We respect the privacy of visitors to our site. We have put this Privacy Policy in place so that you can understand what information we collect through the site, how we use it, and when and with whom we may share it.

The site is owned and operated by Royal Enfield North America Limited, who we refer to, together with our affiliates, as “Royal Enfield,” “us,” “we,” or “our.” When we refer to “you” and “your” in this Privacy Policy, we are referring to you as a visitor to and user of the site.

PLEASE READ THIS PRIVACY POLICY COMPLETELY AND CAREFULLY BEFORE USING THE SITE OR SUBMITTING ANY INFORMATION, PARTICULARLY PERSONAL INFORMATION, THROUGH THE SITE. BY USING THE SITE, YOU ARE AGREEING TO THIS PRIVACY POLICY.

2. APPLICABILITY OF THIS PRIVACY POLICY

This Privacy Policy applies only to information provided and collected through the site. It does not apply to information that we or others may collect through other means, such as information you may provide to to our dealers, information we may learn through a business or employment relationship with you, or information you may provide to us through any other website we own or operate, including our main company site located at www.royalenfield.com. For those other websites, you should review the privacy policies associated with those websites, as they may be very different.

This Privacy Policy may change from time to time. It is our practice to post any changes we make to this Privacy Policy on this page, and any changes will be effective once the new policy is posted. It is your responsibility to check this page for updates. You will be able to determine when this Privacy Policy was last updated by referring to the “Last Modified” legend at the top. By using the site after we post any changes to this Privacy Policy, you agree to accept those changes, whether or not you have reviewed them.

3. How We COLLECT and Use YOUR PERSONAL Information
A. What Is Personal Information? Personal information refers to information that we can use to personally identify a specific individual. Different laws define personal information (and similar terms, such as personal data, personally identifiable information, and PII) to include different things, but it generally includes information like your name, physical address, e-mail address, and phone number. It may also include your computer or mobile device IP address, if that IP address can be linked to a particular person, or geo-location information, again if that information can be used to pinpoint a specific person.

B. Your Choices About Providing Our Information. You can visit and view the site without disclosing any personal information about yourself, other than certain automatically collected information, which we discuss further in this Privacy Policy below. However, if you choose to make use of certain features of the site, you may need to provide certain personal information to us. For example, if you decide to reserve a Himalayan 2021 through our site, you will need to provide us with the information necessary to complete your order, as described further below.

If you are not comfortable with providing information to us, you should not do so. Although that will affect our ability to communicate with you and provide you with products and services through the site, that is your choice. If you do provide us with any personal information, you agree that it will be accurate and complete, and you understand that it is your responsibility to update your personal information as necessary to keep it current.

C. The Personal Information We Collect. Our site has been designed to allow people to place pre-order reservations for the Himalayan 2021. If you choose to make a reservation, you will be asked for the following information:
• Your first and last name;
• Your phone number;
• Your email address; and
• Your street address, including ZIP Code.

You will also be asked for information about your preferences, such as the color and any other optional features of the Himalayan 2021 you wish to order.

When you use our site, your browser may request you to allow it to provide us with your location. In addition, if you access the site on a mobile device, then depending on your permissions and settings, certain location data may be collected, depending on factors such as the device you are using (smartphone or tablet) and how you are connected to the internet (cellular or wifi). We will use this information to direct you to your closest Royal Enfield dealer. Most devices allow you to disable location services, usually via your device’s settings menu. If you have questions about disabling location settings, you should contact your mobile service provider or device manufacturer

In addition, if you reach out to us via any “Contact Us” or similar feature of the site, we will collect any personal information you include in your inquiry.

D. How We Use Your Personal Information. We collect and use this this information to manage and personalize your experience on the site (including locating nearby dealers), to respond to any inquiry you send to us, to manage your reservation request, to communicate with you about your reservation (including sending you a personalized Buyer Code identifying your order), and to provide your chosen dealer with information about your reservation. In addition, subject to your legal rights to opt out under applicable law, we will use your contact information to send you emails, newsletters, or other promotional materials about products and services you may be interested in, to provide you with relevant content, and to seek your feedback on your site experience.

We will also use the information you provide for internal business purposes, such as evaluating interest in our products, to evaluate and improve product and service quality, to comply with legal requirements, and to prevent and address fraud and breaches of our site requirements and policies.

We will keep your information for as long as we continue to have a business need to do so (which will be for at least as long as your reservation and pre-order remain outstanding), unless a longer period is required by law. Business needs include legal, tax, accounting, risk management, and other business purposes.

4. HOW AND WHY WE SHARE PERSONAL INFORMATION
We only share personal information with third parties in the following circumstances:
• We will share your reservation request with the dealer you select when submitting your reservation, which is necessary in order for the dealer to process your request and reserve your selected Himalayan 2021 in inventory.
• We may provide personal information to our trusted service providers who need to use that information to conduct business on our behalf. If we do so, we will provide these service providers only with the information they need to perform their services, and work with them to respect and protect your privacy.
• We may share personal information with data analytics platforms to compile statistics and perform analyses intended to understand our customer base and to improve our site performance.
• We will release information, including personal information, if we believe that doing so is appropriate to (a) comply with law, regulations, legal process, or governmental requests, (b) enforce any policies applicable to the site, including potential violations, (c) detect, prevent or otherwise address fraud, security or technical issues, or (d) otherwise protect the rights, property, or personal safety of us, our employees, site users, or others.
• We may share information, including personal information, in connection with, during negotiations of, or as a part of the closing of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company in which personal information about the users of the site is among the assets transferred.
• We may also share personal information that has been de-identified or anonymized, such as demographic information or aggregate information, with our advertisers and marketing partners for business purposes, such as the development of marketing campaigns.
We do not provide any personal information that we collect about you through the site to anyone for any purpose other than those listed above, and will not do so unless you have given us your separate express permission to do so.

5. How We Collect and Use Non-Personally Identifiable Information
A. What Is Non-Personally Identifiable Information? Non-personally identifiable information refers to information that is not and cannot be used to identify a specific individual. This may include information about the statistical characteristics of the visitors to our site. While this information may define how you fit into a particular group of people, it is not unique to you, and it cannot be used (without other information) to specifically identify you. In addition, this includes some of the demographic information that you may provide when you use our site. Demographic information includes things like ZIP code and product purchase information, once separated from any identifying information. Unless a particular law requires that we treat any standalone demographic data as personal information, or unless we associate it with any personal information in a way that would allow your demographic information to identify you, we will not treat it as personal information under this Privacy Policy. Non-personally identifiable information will also include the personal information we collect that has been anonymized or de-identified, which means we have removed any personally identifiable elements.

B. How We Collect Non-Personally Identifiable Information. When you visit the site or interact with us electronically, we may automatically collect standard internet and website log information, and details of patterns about how our site visitors behave. This information may include your internet service provider name, your operating system, your browser type and browser language, your access dates and times, the website that referred you to the site, the specific web pages you visit and the date and time of those visits, your search terms and queries, and links clicked as you visit the site. We may also use analytics tools that collect information about how the site is used, such as how often users visit our site, what pages they visit, and what other sites they use prior to visiting our site. More information about the technology and analytics services we use to automatically collect information is provided below under the heading “Cookies and other Tracking Technologies.”

C. How We Use Non-Personally Identifiable Information. We use this type of information to understand our visitor and customer base, to gather broad demographic data for aggregate use, to conduct market research, to analyze trends, to develop products and services, and to provide those products and services to other users and third parties. If we associate this non-personally identifiable information with any personal information you provide us, we will treat the associated information as personal information, in accordance with this Privacy Policy.

6. COOKIES AND OTHER TRACKING TECHNOLOGIES
A. Cookies. Cookies are small amounts of data that are stored on your browser, device, or the page you are viewing when you visit a website. As with many sites, when you visit our site and complete a reservation form, we will place a cookie on your computer. We use this to identify you more quickly when you return to the site, and we may use cookies to evaluate your use of and interest in our site. Most browsers permit you to disable cookies, and you can do so by following your browser’s instructions. If you do disable cookies, you may not be able to access certain sections of the site that use essential cookies, and this may make your experiences on the site less efficient. For more information about how we use cookies, please see our cookie policy, available here https://www.royalenfield.com/us/en/legal/cookie-policy/.

B. Analytics Services. Our site may use analytics tools to collect information about the use of our site, so that we can understand our visitors’ online behavior. In these instances, the analytics service provider will be able to use and share information about your visits to and use of our site, and that service provider’s use and sharing will be governed by their privacy notice and online terms.

C. Third Party Tracking Technologies. We may allow third parties to set cookies during your visit to the site. These are third parties that have been selected by us to provide us with information about how you use the site. They may also use cookies, on our behalf, to promote our newest products and services on other websites based on your activity on our site. For example, you may see products that you viewed on our site presented on other websites as you move around the internet.

In addition, various third parties, including our analytics providers and our ad partners, may use cookies, alone or with other tracking technologies, to collect information about you when you use the site for their own purposes, independent from us. These third parties may be able to associate the information they collect with your personal information, or they may collect information, including personal information, about your online activities over time and across other website and online services. They may use this information to provide you with behavioral advertising or other targeted content on other websites and through other media. We cannot control any third parties’ tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.
D. Do Not Track Requests. Currently, certain browsers, including Firefox, Google Chrome, Safari and Microsoft Edge, offer a “do not track” (DNT) option. This option, using a technology known as a DNT header, sends a signal to websites visited by the user about the user’s DNT preference, if any, set on the browser. We do not currently commit to responding to browsers’ DNT signals, because no common industry standard for DNT has been adopted by industry groups, technology companies, or regulators.

7. SOCIAL SHARING FEATURES
Our site may offer social network and similar sharing features, such as Facebook, Twitter, YouTube, and/or Instagram buttons, which let you share information related to the site through your preferred social media platforms. If you permit a connection between our site and your social network page(s), we (and the social network) may be able to identify you, and associate the information we (and they) receive with information we (and they) already have about you. In addition, depending on how you use those features and your settings with the social network provider(s), the information you share to your social network pages will be available to others, including your friends and/or the public. For more information about how your information may be shared through those social networks once it is provided to them, you should review the privacy policies of those social networks.

We also may share certain data with these social networks to allow us to target existing users and customers with relevant advertising. In this situation, we do not share your identification or contact information with anyone. Instead, a unique code is shared with the applicable social network, allowing that code to be matched against existing users of the applicable social network, and to identify potentially relevant audiences for target advertising.

8. Our Security Measures
We use a variety of industry-standard security measures to maintain the safety of your personal information, including measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration and disclosure. We store the personal information you provide on secure (password- and firewall-protected) servers. All electronic financial transactions conducted through our site are protected by encryption technology. Unfortunately, no electronic data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we believe that we use reasonable measures to protect personal information, we cannot ensure or warrant the security of any information transmitted or otherwise provided to us or received from us.

9. YOUR RIGHTS REGARDING Your Information
A. Opting Out of Providing Information. All personal information provided through the site requires your voluntary submission, except for browsing and device information, which is automatically collected if you use the site. You should refrain from visiting the site if you do not want any browsing or device information collected. It is otherwise your choice whether or not to provide us with information, such as by making or declining to make a reservation for a Himalayan 2021 through the site.

B. Opting Out of Certain Communications. You can always opt out of receiving promotional email communications from us by using the “unsubscribe” link contained in those communications, or by contacting us at myprivacy@royalenfield.com. Please note that notwithstanding your email preferences, we may need to contact you regarding outstanding or previous orders, as required by law or regarding legal matters.

C. Correcting and Updating Information. If you believe that any of the personal information we have about you is incorrect, you can contact us at any time at myprivacy@royalenfield.com to request that we make the appropriate corrections.

D. Removal of Information. As noted above, we have standard retention practices with respect to the personal data we collect. If you would like to request any earlier removal of your personal information, please contact us at myprivacy@royalenfield.com. Please note that we may not be able to completely remove personal information from the site or our systems in certain circumstances. This will be true if the data is not in a searchable format, if it is retained in backup systems, if we need it in order to prevent fraud or future abuse, or if we are required by law to keep it. We will inform you if we cannot remove information as requested.

E. California “Shine the Light” Rights. The California “Shine the Light” law permits individuals to request certain details about our disclosure of their personal information to third parties for direct marketing purposes. If you are a California resident and you would like to make such a request, please contact us at myprivacy@royalenfield.com.

10. A NOTE ABOUT CHILDREN
Our site is not directed to persons under the age of 13. We do not knowingly collect personal information from children under 13. If you believe your minor child has improperly accessed the site and provided any personal information, please contact us at myprivacy@royalenfield.com.

11. VISITING OUR WEBSITE FROM OUTSIDE THE UNITED STATES
Our site is intended for a United States audience. If you are visiting our site from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States, where our servers are located and our site is operated. We make no representation that the practices we describe in this Privacy Notice are compliant with the laws of other jurisdictions, including laws that apply to the collection, use, disclosure, and security of personal information.
